New, important changes in Federal Mexico liability laws!
In the U.S., insurance laws are generally governed by each states legislature. Consequently, each state has its own, usually mandatory, minimum limits required to operate a vehicle in their state. Mexico is no different, and is referred to as Code 502.

Recently, Mexico, or more importantly, each state in Mexico, has increased their minimum liability limits for when someone is killed in an automobile accident. Though this is rare, it is the ultimate reason for insurance, to limit your financial exposure as much as possible.

The limit of ones liability in case of a fatality is based upon the minimum wage scale of the state where this scenario occurs. It ranges from (in U.S. $) as high as $ 543,754 in both Mexican States of Coahuila and Yucatan, to as low as $ 4,659 in the State of Sonora. This link provides a list of each Mexican State and the total U.S. dollar amount(s) subjected to recently updated Code 502.

It is in your best interest that your Mexico Tourist Auto policy at least reflect the minimum limits that are implemented for the Mexican States you are traveling through, as well as the State of your destination.

Does NOT include Physical Damage or Theft benefits to your motorcycle. Medical Payments is specifically EXCLUDED for operators or passengers of Motorcycles.

Once a Car Insurance Company declares a Vehicle a "Total Loss", sometimes they sell the totaled vehicle at an auction for example, to recoup some of their loss. If a Dealership, or individual then purchases that vehicle, and makes it road worthy again, they must provide a "Salvaged Title" to anyone they resale it to. This alerts potential buyers about the vehicles history. Each State has its own word for a Salvaged Titled vehicle such as rebuilt, restored, reconstructed, reconditioned, junk, repaired unsafe, non-repairable and of course, Salvaged.

Coverage Description

THIS IS NOT AN “ALL RISKS” BUT A “NAME” RISKS” POLICY AND IT ONLY COVERS THE SPECIFIC RISKS AND COVERAGES NAMED IN THE POLICY AND THAT APPEARS IN THE DECLARATIONS PAGE UNDER THE SPECIFICATION OF RISKS PAGE OF THE POLICY.

ALL LOSSES MUST BE REPORTED BEFORE LEAVING THE REPUBLIC OF MEXICO. IF SUCH NOTIFICATION IS
NOT PROVIDED, THE INSURER MAY BE FREE OF ITS OBLIGATIONS UNDER THIS CONTRACT, WITHOUT THE INSURED BEING INDEMNIFIED (PAID).

CURRENT MARKET VALUE

In case of a total loss, the insurance carrier will adjust on the basis of the Current Market Value/Actual Cash Value (ACV) at the time of the accident. It is imperative that a realistic current market value (ACV) of your vehicle be determined. Under-insuring your vehicle(s) may result in financial penalties in the event of a loss, commonly referred to as a co-insurer. If you underinsure your vehicle of its Actual or Current Market Value, then you are susceptible to the Co-Insurance clause. EX: If your vehicles ACV or Current Market Value is $20,000 and you insure it for $10,000, then you have insured it for half of its value. Consequently, the insurance company is obligated to pay for only half of the claim, minus any applicable deductible. Using this example, if your vehicle is stolen, then the insurance company is obligated to pay half of the $10,000 you incorrectly insured the vehicle for, which is $5,000, minus the $1,000 Total Theft Deductible leaving you with a total Claim of $4,000. In Mexico, it is common to use the N.A.D.A. (National Automobile Dealers Association) appraisal service, the most common service used with U.S. Automobile Dealers in the U.S. It is always best to insure 100% to value.

DEDUCTIBLES

For Full Coverage there is an Obligatory Deductible for Collision, Upset, Glass Breakage and Total Theft for each accident/ on each described vehicle, boat and trailer as established in the Specification of Risk page on the policy.

IMPORTANT

A boat/watercraft and its carrier/trailer shall be considered a one unit under the obligatory deductible clause. Coverage applies on while the unit(s) are attached to the described towing vehicle. Boat coverage under this certificate is limited to physical damage sustained while the boat is being towed by or attached to the towing vehicle provided that full coverage has been purchased and required premium been paid on or prior to the effective date of this policy. Immediately after the occurrence of the accident covered by your policy please contact the claims center, and refrain from entering into agreements and arrangements with the other party until the adjuster is present. Instructions on how to file a claim are provided. The required premiums must be paid on or prior to the effective date of policy. You must possess a VALID U.S./Canadian Driver's License.

THIS POLICY IS FOR THE USE OF TOURIST VISITORS TRAVELING IN THE REPUBLIC OF MEXICO. MEXICAN REGISTERED, LICENSED PLATED VEHICLES AND MEXICAN NATIONALS RESIDING IN MEXICO DO NOT QUALIFY FOR THIS COVERAGE.
